Accordingly, the establishment, reorganization and dissolution of administrative organizations must meet requirements of this new regulation and other relevant legal documents, not exceed the number of organizations prescribed by the Government, the Prime Minister or the competent authorities.
Under this Decree, administrative organizations can be established if they meet 5 following conditions:
- Having a legal basis;
- Meeting establishment criteria of the State's law;
- Having scope and objects under the State's management
- Having their own functions and tasks that are different from other organizations;
- Having functions and tasks that met requirements of the State administrative reform.
The administrative organizations can be reorganized if they changed their functions, tasks, organizational structure, scope and subjects of management; or their operation are not effective according to assessments of the competent agencies.
Administrative organizations shall be dissolved when they have no longer function, task, scope or subjects of management.
