Temporary regulation ‘Adapting safely, flexibly, effectively controlling the COVID-19 epidemic’

Deputy Prime Minister Vu Duc Dam has just signed Resolution No. 128/NQ-CP of the Government promulgating the temporary regulation “Safely adapting, flexibly, effectively controlling the COVID-19 epidemic”.

The resolution stated: From the actual situation, analysis opinions of scientists, experts, opinions of localities, and the National Steering Committee for COVID-19 prevention and control, the Government has determined the goals of the prevention and control work. The epidemic is still a key task in order to maximally protect the health and life of the People, restore and develop socio-economic, ensure security, social order, and safety; redirecting the epidemic prevention and control strategy to “safely adapting, flexibly, and effectively controlling the COVID-19 epidemic”.


The Government promulgates the temporary Regulation “Safely adapting, flexibly, effectively controlling the COVID-19 epidemic” (hereinafter referred to as the Regulation) with the goal of maximum protection of people’s health and life; to minimize cases, severe disease transfer and death due to COVID-19; socio-economic restoration and development, ensuring security, social order and safety; realize the dual goal of bringing the whole country to a new normal as soon as possible, striving in 2021.

In epidemic prevention and control, epidemic prevention must be fundamental and long-term; health care is the core force along with the army, police, … but must mobilize the participation of all forces and classes in society. Promoting the role of people and businesses as the center and subject in epidemic prevention and control, in production, business and safe living.

Safe, flexible adaptation solutions and effective control of the COVID-19 epidemic must be implemented decisively, promptly and drastically; ensure the harmony between professional medical solutions with administrative, socio-economic solutions. Medical solutions must be synchronized between isolation with testing, treatment, and vaccines, under the motto “isolation, testing is the key, vaccines and treatment are prerequisites”.

Specifying specific guidelines on classification, assessment and determination of translation level. Accordingly, the translation level is classified according to 4 levels:

Level 1: Low risk (new normal) corresponds to blue.

Level 2: Medium risk corresponds to yellow.

Level 3: High risk corresponds to orange.

Level 4: Very high risk corresponds to the color red.

Scope of assessment of epidemic level: Assessment from commune level. Encourage assessment from the smallest possible scale (below the commune level) to ensure flexibility and efficiency.

The regulations also specify three criteria for assessing the level of the epidemic, including Rate of new cases in the community/population/time; vaccine coverage (note high-risk age group, first dose rate, full dose rate); the capacity to accept and treat the routes (note clearly defining the acceptability, existing treatment and additional plans).

Regarding the determination of the epidemic level, the Ministry of Health guides the criteria and methods of assessment and determination of the epidemic level. Based on the guidance of the Ministry of Health and the epidemic situation in the area, the People’s Committees of provinces and centrally-run cities decide to change the epidemic level. In case of upgrading the epidemic level, it must notify at least 48 hours in advance to people, organizations and businesses, and prepare before applying.

Measures applied according to 4 levels of translation

Health measures including medical isolation, testing, collection, treatment and vaccination are implemented according to the guidance of the Ministry of Health at all levels. The regulation specifies measures to be applied according to 4 levels of the epidemic for a number of activities of organizations, agencies and businesses, including 1- Organize indoor and outdoor activities to ensure measures epidemic prevention and control; 2- Public passenger transport by road, inland waterway and maritime to ensure the prevention and control of COVID-19 epidemic; 3- Intra-provincial or inter-provincial goods circulation and transportation; 4- Production, business and service (Production establishments, construction units of traffic and construction projects; Business and service establishments including trade centers, supermarkets, shops, etc.) Utilities, wholesale markets; Restaurants/diners, traditional markets; Establishments providing services with high risk of infection such as discos, karaoke, massage parlors, bars, internet, video games, hair (including haircuts), beauticians and other establishments decided by the locality; street vendors, lottery tickets,…); 5- Direct education and training activities; 6- Activities of agencies and offices; 7- Religious, belief and worship establishments; 8- Activities of resorts, hotels, motels, sightseeing tours; cultural, artistic, physical training and sports performances; 9- Application of information technology. For individuals, the Regulation also specifies measures on 5K compliance, information technology application, people’s travel, and home treatment for people infected with COVID-19 at each epidemic level. 

Apply uniformly across the country

This provision is applied uniformly throughout the country. Based on the instructions of the Ministry of Health and other ministries and branches, the People’s Committees of the provinces and cities shall decide on appropriate administrative measures, including specific regulations and instructions on capacity, quantity participants in the production, business, service, culture, arts, events, etc., and can flexibly apply specific additional measures but not contrary to regulations Decisions of the Central Government, do not cause congestion of goods circulation, production and business, travel and daily life of the people. If the regulations and guidelines of the Central Government are not suitable or feasible, they shall promptly report them to the agency promulgating regulations and guidelines. Agencies promulgating regulations and guidelines must immediately direct to remove obstacles and study amendments to regulations and guidelines.

The Chairman of the Provincial People’s Committee decided to isolate the region’s health (blockade the outbreak) as quickly and as narrowly as possible, and implement activities to ensure social security and access to health services for people to enjoy. rest assured to comply with regulations on epidemic prevention and control.

Temporarily not applying the provisions of Clause 1, Article 1 of the Government’s Resolution 86/NQ-CP dated August 6, 2021 and Directives No. 15/CT-TTg dated March 27, 2020, Directive No. 16/CT-TTg dated March 31, 2020, Directive No. 19/CT-TTg dated April 24, 2020 of the Prime Minister, Decision No. 2686/QD-BCDQG dated May 31, 2021 of the Steering Committee National prevention and control of COVID-19 epidemic. In case it is necessary to apply epidemic prevention and control measures on a province-wide scale, higher than those specified in this Regulation, the chairperson of the provincial-level People’s Committee shall report to the Ministry of Health and the Prime Minister. government.
